One of the requirements for extending your spouse visa after 33 months is the ‘subsisting relationship requirement’. This means:
- You must still be in the same eligible & genuine relationship with the same person you were in when you were granted your first Spouse Visa.
- Your partner or spouse must be either a British national, a person present and settled in the UK (i.e. British national, EU Pre-Settled or Settled Status, or Indefinite Leave to Remain), or a person who has been granted refugee status or humanitarian protection in the UK.
- You are still in a marriage or in a civil partnership with your partner or in a relationship akin to marriage for at least the preceding 2 years before your initial visa was granted.
